本研究透過案例研究方式,於溫泉開發許可審查議題區分為:溫泉使用設施、用地容許使用項目、溫泉水文地質、井體構造與取水設施、冷水來源、開發影響評估、溫泉資料監測、溫泉廢汙水排放、溫泉使用量評估、防災措施建置、環境災害分析等。關於溫泉使用設施議題,本研究認為新設置之溫泉開發許可案,在尚未鑿設溫泉井與溫泉設施容量前即須提出申請,要求先確認使用設施以換算使用量,造成申請過程困擾與疑惑。用地容許使用項目議題,新開發案現場仍是一片空地,溫泉開發許可僅針對井、管線及第一儲槽為審議範圍,而議題卻常出現溫泉使用事業之合法性,與上一項之審議範圍確有需釐清之必要性。關於井體構造與取水設施議題,由於尚未鑿設溫泉井,井深僅能先以地質條件提出概估值,開發設備當然也僅能先以周遭其他業者目前開發狀況進行預估。冷水來源議題應為一般水權轄管範圍,此項審議範圍也確有需釐清之必要性,在開發影響評估議題,要單一個案開發申請單位進行影響評估則技術門檻太高。 The hot spring development permit examination topics in this case study are divided into: hot spring use facilities, land use projects, hot spring hydrogeology, well structure and intake facilities, cold water sources, development impact assessment, hot spring data monitoring, hot spring waste water discharge, hot spring usage amount, disaster prevention measures, environmental disaster analysis.In the case of hot spring facilities, this study considers that the newly installed hot spring development permit has to be made before the installation and facilities. It is required to confirm the use of the facilities in order to convert the usage and cause the application process to be troubled and doubted. The land use permission item, the new development site is still an open space, hot spring development permit only for wells, pipelines and the first storage tank for the scope of the consideration. The problem is often the legitimacy of the hot spring use. Need to clarify the necessity.With regard to the problem of well structure and water abstraction facilities, since the hot spring wells have not yet been drilled, the well depth can only be estimated on the basis of geological conditions. The development equipment can estimated by the current development of other industries. The cold water should be the the general water rights jurisdiction. The scope of this problem also needs to be clarified. In the development of impact assessment issue, the technical threshold is too high for a single case development unit to carry out the impact assessment.
