    Title: 勞工安全衛生教育訓練補助方案之探討

    Abstract: 本研究以職業災害勞工保護法第十條所規定之勞工安全衛生教育訓練補助方案為研究範圍,依據相關法令規定與作業模式,分析勞工安全衛生教育訓練補助方案的實施概況,並以2006年至2010年台南縣總工會向勞保局申請有關勞工安全衛生教育訓練補助方案為例評估成效,透過分析及滿意度調查,深入探討並評估有關職業災害勞工保護法對勞工安全衛生教育訓練補助方案實施結果,並針對問題提出改善建議。結果顯示,勞工安全衛生教育訓練有助於增進勞工職業災害之認知,強化勞工自我保護及安全衛生意識,並具有預防投資功能;降低職災發生率,減少職災保險支出、保險費負擔與災害事故之間接損失、減少社會成本支出及勞資爭議,提高生產力等效益。研究發現,若干問題亟待改善,如: 政策方向不夠明確,缺乏辦理勞工安全衛生教育訓練宣導補助方案法令規範;缺乏對補助對象評鑑標準,受訓人員無法擴及全面勞工,缺乏合理評估教育訓練與宣導成效及受訓人員的考評,經費補助缺乏標準,補助撥款延宕費時,其他如審查拖延與標準不一等。本文建議:應另訂勞工安全衛生教育訓練宣導補助辦法及其作業要點,建立辦理勞工安全衛生教育訓練宣導單位評鑑制度,勞工安全衛生教育訓練宣導受訓對象採開放式報名方式;檢驗勞工安全衛生教育訓練宣導成效,如建立考評制度,檢視執行單位是否依據計畫或契約執行,核發受訓人員的相關訓練證明及訂定勞工安全衛生教育訓練宣導補助經費應定補助標準。
    This research was to study the benefit of grant programs of labor safety and health education and training (LSHET) which is prescribed in the 10th article of “Act for Protecting Worker of Occupational Accidents”. This study used the related regulations and operating guidance to analyze the practical situation of grant programs regarding this Act. It also selected the Tainan County Federation of Trade Unions’ application for grant programs of LSHET to Bureau of Labor Insurance from 2006 to 2010 as an example for evaluating the practical situation. The analysis result of the satisfaction survey was also used to evaluate the practical effectiveness of the grant programs of LSHET regarding the Act. Results showed that LSHET is useful to enhance labors’ awareness about occupational accidents, strengthen labor’s self protection and awareness of safety and health. It is also proven the function of “prevention investment”, reduces the incidence rate of occupational accident, cuts down the expenses of occupational accident insurance, lessen the burden of insurance premium, decreases the indirect loss of damage and accident, cuts down the expenses of social cost, reduces labor disputes, and raises productivity, etc. However, for some situations such as the unclear direction of the policy, lacking regulations of the grant programs of LSHET, lacking standards to evaluate the trainees, related education and training courses cannot be extended to all labors. Lacking of the standards of grant subsidy, the disbursement of subsidy delays, taking too much time, the delay of appraisal, and the inconsistent standards also exist.Some suggestions from this study are: subsidiary rules and operation guidelines of the related propaganda should be enacted separately;the evaluation system for the executive level should be established;the method of registration for trainee should be made public and accessible;it should establish an assessment system to examine the result and to check if the executive unit implements according to the plan or contract;and there is need to issue the certificate to the relevant trainee.
