溫泉旅館是一個提供住宿、餐飲、泡湯的場所,因為擁有溫泉泡湯設施,因而泡湯成為其核心服務,故有別於一般的旅館。溫泉旅館所提供的服務主要標榜休閒、度假及健康促進,但是如果使用不當也會衍生安全及衛生的問題,且溫泉業者在營運過程常因安全衛生管理不當,而引發諸多的意外事故案例,如中毒、感電、燙傷、滑倒等意外,而其中如何預防這些事故,溫泉旅館之從業人員及政府單位扮演著關鍵的角色。在我國勞工安全衛生法之適用範圍包括餐旅業,溫泉旅館亦涵蓋在內,本研究以問卷方式從消費者及溫泉業者挖掘溫泉旅館存在之安全衛生管理問題,並試圖以勞工安全衛生法之相關規定來探討其適用性,提供法規面的建議,讓溫泉旅館能強化其服務品質以確保消費者的權益。本研究共獲得160份有效問卷,此問卷資料以基本統計量表進行分析,並與溫泉旅館經理訪視面談。研究結果顯示大部分的從業人員及遊客針對溫泉法及安全衛生法的條文大都不清楚,且因泡湯客的安全認知及文化也有所不同,對於法條機械設施防護檢點更是缺乏有效管理,也未設置相關的安全急救方面的人員,主要原因就是員工與遊客都缺乏安全方面的認知與訓練,及目前法規未明確規範管理,造成溫泉經營者與遊客對於該如何落實安全管理渾然不知,如此沒有法源的管理及人員缺乏訓練,對於場所的潛在危害就無法排除與防範事故於未然。 The hot spring hotel is a locus with hot spring facilities to provide for stay, meal, and bathing. Soaking hot spring is the main service in hot spring hotel different from other kinds of hotel. Recreation, vacationing, and health promotion are the foremost services provided by hot spring hotel. If the hot spring facilities improperly used, the safety and health problems derived from those facilities would occur. There are many accidents, e.g. poisoning, electricity shock, scalding, slipping etc. happened in hot spring hotel, and how to prevent these accidents is become an important issue for managers of hot spring hotel and officers of government. The labor safety and health act is applied to the restaurant and hotel industries, including the hot spring hotel. The purpose of this study is to explore the safety and health problems existing in hot spring hotel by questionnaire and field survey. An attempt was made to examine the application of labor safety and health act to the safety and health installations and management in hot spring hotel. 160 valid questionnaires from customers and staffs in hot spring hotel were gotten and analyzed by basic statistics software module. The field survey was undertaken by interview with managers of hot spring hotel. The findings of the study revealed most of the staffs and the customers did not realize the items in hot spring act and labor safety and health act. The recognitions and aspects of safety and health management in hot spring hotels between the staffs and the customers were more different. The facilities at hot spring hotels were short of safety and health devices and the safety and health managements were not valid. The defects mentioned above were derived the inadequate safety and health trainings for staffs and improper managements for facilities. For no suitable safety and health regulation to standardize the facilities and managements at hot spring hotels, the study addressed labor safety and health act and its regulations are the better choices to apply to. The results would offer the references and suggestions for the government to add the safety and health regulation into modified hot spring act.
